Associated Press AVENTIS SETTLEMENT ND reaches settlement with Aventis Bismarck, N.D. (AP) North Dakota is getting about $108,000 as part of a larger $95.5 million settlement with Aventis Pharmaceutical Inc. over the cost of NASAl sprays. The Justice Department recently said the subsidiary of drug maker Sanofi-Aventis agreed to pay the government the money to settle allegations it cheated Medicaid. The government charged that between 1995 and 2000, Aventis and its corporate predecessors did not offer Medicaid the best prices for the sprays Azmacort, Nasacort and Nasacort AQ. In reaching the settlement, Sanofi-Aventis U.S. did not admit any wrongdoing. The North Dakota Department of Human Services says the state has agreed to accept a $240,000 settlement, about $132,000 of which will go to the federal government. Fargo FALL Man falls from roof of Fargo Civic Center FARGO, N.D. (AP) Police say a man in his mid-20s is lucky to be alive after plummeting about 35 feet from the roof of the Fargo Civic Center. Authorities say two people were on the roof about 1:30 a.m. Thursday. One climbed down. The other jumped or fell, hitting a guard rail and then striking his head on the sidewalk. He was taken to a local hospital. Police Sgt. Bill Ahlfeldt says the man was alert and talking after the fall but had a cut on his head. Ahlfeldt says an officer witnessed the incident, and the two people could face trespassing charges. Authorities say they had been drinking. Wahpeton SHOOTING Arrests made in Wahpeton shooting WAHPETON, N.D. (AP) Two people are in custody after an incident that Wahpeton police describe as a "drive-by style" shooting. Authorities say a man in a car fired several shots from a handgun toward a mobile home shortly before 9 p.m. Wednesday. A woman and eight children were in the home and yard, but authorities say no one was hurt. Police say they have not determined a possible motive. Police stopped the suspect vehicle a short time later in neighboring Breckenridge, Minn., and arrested the woman who was driving and the male passenger. Authorities say felony charges are pending. Dunn County KILLING Texas man pleads not guilty in ND killing Dickinson, N.D. (AP) A Texas man accused in the shooting death of a Dickinson man has pleaded not guilty to murder. Thirty-nine-year-old Shane Miller is accused of shooting 49-year-old Neal Matejovsky twice, in the arm and chest and the second time in the neck. Matejovsky's body was found April 10 in a Dunn County field. Police Detective Kylan Klauzer said in court that at least three people have told police they heard Miller talk at a party about committing the murder. Klauzer also said that another man Benjamin Orf, who authorities said was Matejovsky's stepson at one time also was at the scene and is believed to have stabbed Matejovsky after he was shot. Orf is charged with being a felon in possession of a firearm. A prosecutor said other charges are pending. Klauzer said Matejovsky allegedly abused Orf when he was a child a possible motive for the killing. The detective also said Orf sometimes refers to Miller as "dad," though authorities do not believe the two are related. (AP) A resident at a Grand Forks independent-living facility that houses the elderly and others in need of care spent some time behind bars for assaulting a 78-year-old nun. Police say 47-year-old Dorothy Peltier pleaded guilty to misdemeanor simple assault and spent a night in jail this week. The nun wasn't identified. Sister Rebecca Metzger, an administrator at St. Anne's Guest Home, called the incident "very minor" and said the nun was OK. The incident occurred during a dispute over when Peltier would be allowed on a home visit. The nun reported that Peltier threw part of her headdress on the floor, damaged her glasses and struck her in the face. (AP) The Grand Forks mosquito control program supervisor says standing water can breed mosquitoes, and he's urging people to clean their gutters and yards. Todd Hanson says mosquito trap counts are likely to increase in the next few weeks. He says the Culex mosquito, the one that carries West Nile virus, lays eggs in standing water. Information from: KXPO-AM OSHKOSH-Army CONTRACT Oshkosh evaluates job needs after $1B contract; Oakes plant still closing MILWAUKEE (AP) Oshkosh Corporation says it's too early to know how many jobs its new billion-dollar military contract will create, but the number is "significant." The contract awarded this week to the Wisconsin company calls for more than 2,200 bomb-resistant all-terrain trucks. The Defense Department says it urgently needs strong protective trucks that can maneuver Afghanistan's rocky terrain. Robert Bohn is Oshkosh's chairman and chief executive. He says the company is evaluating its production and employee needs this week. The truck's cabs will be built at JLG, an Oshkosh subsidiary in McConnellsburg, Pennsylvania. Bohn says an unknown number of laid-off workers there will be brought back. But the company still plans to close its plant in the southeastern North Dakota town of Oakes. SANITIZED COURTHOUSE Hand sanitizers placed in federal courthouse FARGO, N.D. (AP) Visitors to the federal courthouse in Fargo are being encouraged to wash their hands. Battery-powered hand sanitizer dispensers have been placed just inside the doorway. A message on the dispenser says "healthy hands start here." A large poster on the courthouse door says clean hands reduce the spread of germs. The poster and the dispensers were authorized by the government's General Services Administration.
