Gibbs guilty of murderNov 16 2007 11:15PM
KXMBTV Bismarck Jurors deliberated for 27 hours and at 4:35 this afternoon they gave a guilty verdict... Donnell Preskey has reaction... For the last three days there has been a lot of sitting and waiting And the waiting is even harder this time around it's the second time Moe Gibbs has been on trial for Mindy Morgensterns death. (Nat Sound Verdict) Guilty of Murder.. Words that family and friends of Mindy Morgenstern have been waiting 14 months to hear... Words they didn't hear after the first trial And after a jury convicts their daughters murderer Mindy's mom's words to us are not about victory (Eunice) "It's hard no matter what way it would go, because there are two losses. For their family there's a loss and Mindy still isn't here, but it was the lords will because we've been praying for justice to be done." Justice in this case took some time... Gibbs first trial ended in a hung jury But friends and family say they were never worried this time 2:59 (Liz) So relieved this is what we've been waiting 14 months for... Justice has been done today... (Becky) We knew it was going to come, Justice will be served the DNA was everything A DNA expert that told jurors Gibbs DNA under Mindy's nails was from vigorous contact. Mindy's friends say the fact that it was blood that was on her nails also made a difference in this trial. Mindy's death is not how her parents want their little girl to be remembered.. (Larry) she made her own legacy. Nothing we did for her. Shes touched many people and that is what we are really thankful for. Shes not forgotten and we know she wont be because of the garden in Valley City and the peple that knew her there and the people that knew her here. (Eunice) And there will never be another Mindy... And we miss her so much.. And that's something no guilty verdict can heal... Moe Gibbs will be sentenced December 17th He faces life in prison for murdering Mindy. The 12 jurors walked by the media today not wanting to make any comments. During Gibbs' first trial in Minot last summer, jurors deliberated more than 22 hours before Paulson declared a mistrial. Those jurors said they were deadlocked 6-6.
