Associated Press NORTH DAKOTA NICKNAME Discussion of ND nickname not of ed board's Agenda Grand Forks, N.D. (AP) The state Board of Higher education will meet next week at the University of North Dakota, but no discussion of the Fighting Sioux nickname is planned. UNDer a settlement with the NCAA, UND must get approval from two Sioux tribes to continue using the nickname and Indian-head logo, which the NCAA considers offensive. The state board voted to abolish the name and logo unless it gets tribal support by Oct. 1. Attorney General Wayne Stenehjem said Friday that the board should extend the deadline to allow time for a new Standing Rock Sioux council to take office. Elections are Sept. 30, and the current council has refused to allow a vote on the nickname. The Spirit Lake Sioux tribe took a vote in April with more than 65 percent of its members supporting the nickname and logo. (AP) The family of a woman who died after falling in a fitting room at a Grand Forks Wal-Mart has filed a wrongful death lawsuit in federal court. The complaint accuses Wal-Mart of negligence in the 2007 death of Cynthia Gaddie of Grand Forks. Her family says a store employee placed a portable clothing rack behind Gaddie while she was in the fitting room, and she tripped over it and fell. The lawsuit seeks at least $50,000 in damages. Lawyers for Wal-Mart say the fall was Gaddie's fault and the lawsuit should be dismissed. HOPE CRASH 1 dead, 1 hurt after crash near Hope, ND HOPE, N.D. (AP) One person is dead and another injured after a head-on collision east of Hope. The North Dakota Highway Patrol says a 21-year-old Hope man was traveling east on County Road 5 and collided with an oncoming car about 2:30 a.m. Saturday. The man was thrown from the pickup, which ended up in a ditch. The patrol says the car caught fire and the driver a 20-year-old woman from Bismarck was killed. The names of the victims have not been released. The condition of the injured man was not immediately available. PRESIDENT'S HOUSE Cost of NDSU president's home climbs to $1.47M Fargo, N.D. (AP) The cost of the new president's home on the North Dakota State University campus has climbed to $1.47 million, more than 60 percent over budget. NDSU officials are expected to ask permission next week from the Legislature's Budget Section and state Board of Higher Education to exceed the $900,000 authorized for the project. Money for the home comes from private donations to the university foundation. Foundation director Jim Miller has said severe cold last winter and spring flooding prevented crews from working, resulting in overtime costs to keep the project on schedule. He said construction material costs also rose last summer. NDSU President Joseph Chapman and his wife moved into the house at the beginning of the semester. (AP) The northeastern North Dakota community of Walhalla is getting $431,000 in federal money to help build an industrial park. The state's congressional delegation says the grant through the U.S. Department of Commerce will be used for road, sewer and water infrastructure to help attract private businesses. Officials estimate the industrial park will create more than 200 jobs and leverage $38 million in private investment. Dickinson FISH KILL Junk fish kill under way at Patterson Lake DICKINSON, N.D. (AP) North Dakota Game and Fish Department workers have started a massive fish in a watershed pond north of Patterson Lake in Dickinson. It's the first step to eradicate so-called junk fish so the lake can be replenished with game fish to replace those lost in the winter kill. The agency says it's still safe to swim in Patterson Lake because the work is now limited to the watershed. The fish kill in the lake itself is scheduled to start the first week of October. Agricultural insecticide rotenone is being added to the water. The fish will eventually die as the chemical depletes the oxygen from the water. The chemical lasts in the water three days to a week. Organizers say the Badlands Appreciation hot air balloon rally is going on its eighth year. The Theodore Roosevelt Medora Foundation and private balloonists come to the Badlands for a weekend of hot air balloon rides. The rides are by invitation only, but the public is invited to watch the balloons and take pictures. Organizers say the balloons will be filled and take off near Medora's Badlands Hotel. Randy Hatzenbuhler is president of the Theodore Roosevelt Medora Foundation. He says people like to come and watch the balloons as well as play Golf, or just drive through the park.
