The department said Friday the patient was a Todd County resident in the 30-39 age group.

The Health Department has said victim's names and other details can't be released due to state confidentiality statutes.

More than 330 cases of H1N1 have been confirmed in South Dakota.

So far, 29 patients have had to be hospitalized because of influenza.

The state expects to start offering H1N1 vaccine to high-risk groups such as pregnant women and young children by mid-October.

Fischbach says that according to state law, adult-oriented businesses established after June of last year cannot open within a quarter mile of a playground.

A playground sits right across the street from the Mansfield juice bar.

The prosecutor says each day of violation is a separate offense.

The juice bar was supposed to open next weekend.

Mayor Jay Ostrem says he can't be specific about the reason because of personnel rules. But he says it had to do with city employee guidelines that deal with offensive conduct and language, refusing to perform job assignments and failing to follow supervisors' orders, among other things.

Kopman has denied the city's allegations and has hired a lawyer.

She has decided not to talk publicly about her suspension.

She is to remain suspended until the council talks about the issue again on Oct. 19.

Ostrem says he hopes the issue will be resolved at that time.

Information from: KELO-TV, http://www.keloland.com AIM SLAYING Lawyer: 1975 slaying appeals hearing unwarranted SIOUX FALLS, S.D. (AP) The South Dakota defense lawyer for a Canadian man charged with killing a woman in 1975 says a rehearing before a full appeals court is not warranted because prosecutors have repeatedly lost their argument.

A district judge and a three-judge panel ruled that John Graham can't be tried on one of three counts in a U.S. court because he does not belong to a federally recognized American Indian tribe.

He and another man are charged in federal court with killing or aiding and abetting the murder of Annie Mae Aquash (AH'-kwash) when they were affiliated with the American Indian Movement.

Graham is also charged with another person in state court.

His lawyer says prosecutors should not be given a rehearing before the full 8th U.S. Circuit Court of Appeals.

IRS ALERT IRS warns of bogus e-mail ST. PAUL, Minn. (AP) The IRS is alerting taxpayers in South Dakota and North Dakota to a phony e-mail about underreported income that the agency said is being used in a "phishing" scam to gain access to personal information.

Spokesperson Carrie Resch said the IRS does not send unsolicited e-mails to taxpayers and that anyone receiving an e-mail claiming to come from the IRS should not open any attachments or click on any links.

She said doing so could download a computer virus that gives the sender access to security passwords and banking information.

PRANK CALL Police department warns of dangerous prank call PIERRE, S.D. (AP) The Pierre Police Department is investigating a prank call to a KFC Taco Bell restaurant that resulted in the fire suppression system being activated and several employees being exposed to chemically treated water.

A release from Attorney General Marty Jackley says workers at the restaurant got the call at about 3 p.m. Thursday and that a store manager was led to believe it was from the corporate office.

The caller told the manager that the fire suppression system had gone offline and that the manager should reset it. The system was activated, and the release says chemically treated water contaminated food and caused skin irritation to employees.

Officials say similar incidents have been reported in other states. Authorities say businesses getting such calls should contact their corporate offices directly.
