Associated Press DENTIST SLAYING ND hearing set in custody of slain dentist's daughter Fargo, N.D. (AP) The brother of a slain Fargo dentist says an Oklahoma judge has given North Dakota jurisdiction in a custody battle over the dentist's daughter. Roy Gattuso said a judge in Fargo may decide at a hearing Tuesday who gets custody of 3-year-old Kennedy Gattuso. She had been living with her father, Philip Gattuso, who was killed Oct. 26 in his south Fargo condominium. The child now is in the custody of her aunt, Regan Williams, in Jones, Okla., near Oklahoma City. Williams' father, Gene Kirkpatrick, also of Jones, is charged with conspiracy to commit murder. Prosecutors allege Kirkpatrick hired his handyman, Michael Nakvinda of Oklahoma City, to kill Philip Gattuso because he did not like the way Gattuso was raising Kennedy after the death of the dentist's wife, Valerie, who was Kirkpatrick's daughter. She died in March after an extended illness. (AP) The Justice Department says the city of Fargo has agreed to make improvements to buildings, restrooms and other facilities accessible to people with disabilities. Federal officials say the agreement was reached under "Project Civic Access." The program seeks to bring state and local governments into compliance with the federal law barring discrimination against disabled people. A Justice Department statement released Monday says the city of Fargo has agreed to make its facilities more accessible, to publish a notice about the federal law and to adopt a grievance procedure for dealing with complaints. A federal audit found the city lacked compliance with some parts of the federal Americans with Disabilities Act. City officials have said most of the problems could be fixed without major cost. JAIL FALL LAWSUIT Former jailer serving life sues over jail fall FARGO, N.D. (AP) A former jailer sentenced to life in prison for killing a Valley City State University student is suing Cass County and jail officials for $24 million, saying he injured his right wrist in a 2007 fall in the jail in Fargo. Moe Gibbs filed the lawsuit Monday in federal court. Cass County Sheriff Paul Laney did not return a call seeking comment. Laney had said in November 2007, a week after Gibbs was convicted of murder, that he got a notice Gibbs would seek $24 million. Gibbs was convicted of strangling 22-year-old college student Mindy Morgenstern, of New Salem. He later pleaded guilty to a 2004 rape in Fargo, and to charges that he assaulted five women inmates at the Barnes County jail where he had worked as a jailer. Gibbs' wrist was bandaged during his two murder trials. He was convicted in Bismarck after his first trial in Minot ended in a jury deadlock. WEEKLY CROP REPORT Weather continues to boost ND harvest gains FARGO, N.D. (AP) The U.S. Department of Agriculture says North Dakota farmers continue to make progress with harvest, thanks to warm, dry weather. The weekly crop report released Monday notes good progress on dry beans, Soybeans and sunflowers, while the Corn harvest has made only small gains. Corn ear mold remains a concern for some producers that saw heavy precipitation in October. The dry edible beans harvest is 96 percent complete. Soybeans are 80 percent harvested, although still lag behind the 98 percent average. The sunflower harvest is 60 percent complete up 28 percentage points from last week. The corn harvest is 8 percent complete. Livestock producers continue selling calves, hauling hay and moving cattle to winter quarters. GRAIN TRUCK CRASH 3 go to hospital after wet spill; snowplows called CASSELTON, N.D. (AP) Four snowplows were sent out on Interstate 94 west of Fargo after a truck hauling wet distillers grain, an ethanol plant byproduct, left part of its load on the interstate. The Highway Patrol said the interstate near Casselton became slippery after the spill late Monday morning and a minivan slid out of control, then was hit by a car. Highway Patrol Sgt. Troy Hirscher said three people were taken to a Fargo hospital with what were believed to be minor injuries. The patrol said a helicopter landed on the interstate to pick up one of the victims. (AP) Cavalier County authorities say someone cut a hole in a wall to get into a Langdon store, then cut open a safe and took money from it. A statement from the sheriff's office said the burglary at the Warehouse Foods Store happened early Sunday morning. The amount taken was not released.
