BILLINGS, Mont. (AP) A McCone County commissioner accused of ordering a county crew to improve the private road to his house is facing a charge of felony theft and a misdemeanor charge of official misconduct.

Patrick Eggebrecht of Vida, in northeastern Montana, is set to make his initial District Court appearance in Circle on Thursday.

He said Monday he could not comment on the charges.

Court documents filed Nov. 16 accuse Eggebrecht of ordering a county road department foreman to build a road to the house in August. The documents say a crew using three graders worked about 21 hours on the road before commissioners held a special meeting and ordered them to stop.

The road is about a mile long on private land and serves only Eggebrecht's home. Court records say the "the work performed was an extensive improvement."
