Associated Press SUPCO-BREAST IMPLANTS ND Supreme Court mulls value of breast implants Bismarck, N.D. (AP) North Dakota's Supreme Court is considering whether the value of breast implant surgery should be considered as part of a divorce case. Attorney Christina Sambor argues that cosmetic surgery is expensive, and she says its value should be counted when a husband and wife divide up their assets in a divorce. Sambor represents Erik Isaacson of Mandan. She spoke to the Supreme Court on Thursday during arguments in the case. When Erik Isaacson was divorced from his wife Traci, he listed the surgery as a $5,000 benefit to his wife. South Central District Judge Robert Wefald refused to count the expense against Traci, saying it would be ridiculous to do so. Wefald's decision is being appealed. Traci Isaacson's attorney, Sherry Mills Moore, says Erik Isaacson barely mentioned the issue during the couple's divorce trial. Moore says it wouldn't be right to consider it on appeal. VETERANS FUND Question arises over veterans trust fund BISMARCK, N.D. (AP) A North Dakota veterans group and state Treasurer Kelly Schmidt are looking to Attorney General Wayne Stenehjem for clarification on the handling of some money in the Veterans Post War Trust Fund. The Administrative Committee on Veterans Affairs wants to use $450,000 that it considers a reserve fund for grants to help needy veterans with such items as eyeglasses, hearing aids and dentures. Schmidt says her office has full constitutional and legal control of the trust fund not just for investment purposes but also for determining how much can be distributed. She says the $450,000 cannot legally be a separate fund. Schmidt says she and the veterans group are working together to clarify the legal administration of the fund, and are looking to Stenehjem to help settle the matter. She also says that in the past five years, more than $500,000 has been given out in grants for personal items such as hearing aids. Williston JUDGESHIP Williston judge says he's stepping down next year BISMARCK, N.D. (AP) A Williston state district judge says he won't run for re-election next year. Gerald Rustad informed the North Dakota Supreme Court on Thursday of his decision to leave the bench. Rustad says he'll depart when his current six-year term ends in December 2010. Rustad is a Williston native who served as county prosecutor and Williston city attorney. He was first elected to his district judgeship in 1992. The Supreme Court now will take comments on whether Rustad's job should stay in Williston or be transferred elsewhere. Rustad says he believes the job should stay in Williston. Rustad serves in the six-county Northwest District, which includes the cities of Minot and Williston. The district now has two judges in Williston and four in Minot. A fifth Minot judge, Todd Cresap, is taking office in January. Rustad is the second North Dakota district judge to announce retirement plans. South Central District Judge Robert Wefald of Bismarck also intends to leave office when his term ends next year. LURING CHARGE Minnesota man faces luring charge in ND WEST Fargo, N.D. (AP) A 65-year-old Minnesota man is accused of luring a 14-year-old North Dakota girl over the Internet, then meeting her in person this fall and having sex with her. West Fargo police say the man from Zimmerman was arrested on a felony luring charge. He had not been formally charged on Thursday. Police Detective Ken Zeeb said the man is a traveling salesman and was arrested in Bismarck. He will be brought to Fargo to make his initial court appearance. GACKLE FATAL Rollover kills Gackle man GACKLE, N.D. (AP) A sport utility vehicle rollover in Logan County has killed a 54-year-old Gackle man. The Highway Patrol did not immediately identify the victim of the crash that happened about 6 a.m. Thursday. Authorities say the man's SUV was traveling on state Highway 46 when it went into the ditch, hit an approach and rolled. The man was thrown from the vehicle and died at the scene. DAKOTAS-RESERVOIRS Oahe, Sakakawea above normal SIOUX FALLS, S.D. (AP) The Army Corps of Engineers is more than doubling water releases from Lake Oahe this month as the demand for hydropower-generated electricity increases with the start of the winter heating season. The corps says the reservoir in the Dakotas still will end December nearly 10 feet above normal. Long-term drought has ended in the Missouri River basin, and the corps says all of the reservoirs except Fort Peck are at above-normal levels.
