It is so bad that we house juvenile registered sex offenders in foster care group homes along with victims of sexual abuse. Magnificient logic from DHS and DJS. Put an adult with the mind of a 5 year old on the sex offneders unit of the state hospitial and what happens, he get raped. Our officials have absolutely no sense.

And then goes to school and brags about her accomplishment. Registered for life...because she's under 15. Serves at least 2-3 years in the Penn. Nothing prior on the rap sheet. Just looking for some comments.

Posted by to someone on Jan 29 2008 10:44AM - my brother plead guilty to promoting obscenity in July 04...original charge was GSI. The state all out said they had no credible witness, but he took the plea because his atty said to. He was evaluated and there was no registration recommended. However, 4 months later he got a new PO who said he didn't agree and made him register/go to treatment or go to jail. There was never a court order for him to register. The PO changed his probation under threats about 5 more times in less than a year. When I found out what was happening I hired an attorney, and called the PO supervisor. Two days later my brother was in jail, held for 3 months before trial, and found guilty of violating probation and resentence to 5 years in prison. There is still NO COURT ORDER for registration/treatment, however, that was one of the "violations". The PO lied in court about other "violations" (I have the transcripts to prove it) and now my brother has been moved from a no risk, no registration offender to a high risk lifetime offender, even though his only crime was having nude pictures in his nightstand. And he was thrown out of prison SOT becasue he wouldn't say he committed GSI. My brother is also borderline retarded. He has absolutely no concept of common sense. He did not file an appeal, while in prison, because he said he had no time. Er? But 5 years in prison for being retarded is harsh. The sex offender laws need to be evaluated. Period.

Posted by arlo on Jan 30 2008 8:28AM - First of all none of these cases involve an 18 year old. Secondly I was 18 once and had a 15 year old GF and was smart enough to not do those things. If you want to screw around don't date somone that could get you thrown in jail.

I love how these creatures can ruin many many lives and they get thrown in jail for a few years and have their names put on a website and mentioned once onthe news. Incases where there is real physical evidence they should be excuted or at least branded so it is visibal from all angles. That way when they become the cook at your favorite chain restaurant you will know who is cooking your overpriced TV dinner.

Most people who are familiar with indivuals that are mentally or physically challenged usually use a more politically correct term! Also, does a criminal ever admit to their crime? In my career field, EVERYONE that's incarcerated claims their innocence and thinks THEY'RE the victim. No kidding!!!

You nit wit, obviously not all 18 year olds are dumb enough to have 14 and 15 year old girlfriends....most of the time sex between 18 and 14 would be a "one night stand" (heard of that before?). Have you seen Myspace? Looking through my children's sites, nearly ALL their female friends list their age as about 2-5 years older than they actually are.

Did you know, that if a girl is under age 15 there is no legal authority to say you "thought" she was older. In other words, if a 14 year old girl gave you every indication she is 17 or 18, and you have sex with her...the law doesn't care that you genuinely thought she was older. Age 14 is the magic number...lack of knowledge is no excuse. Do a little searching on some teenage girls myspace sites...see what they list as their age. Then post a new reply.

Posted by anon on Feb 6 2008 1:01PM - I turned over pictures (from myspace accounts) showing my brother's stepdaughter (12) and stepson (14) smoking cigarettes and drinking alcohol. The police did nothing. There are now pictures of of the girl engaged in lesbian activities with 17 year old girls. I did my part. Why don't the cops do theirs? The girl's site says her age is 15.

Posted by the first someone on Feb 7 2008 5:58PM - I've done a lot of research on sexual offenses. Sexual Contact can be any fondling (even outside of clothing). When there is more than 3 years difference between the offenders age and the "victim," even if the offender is UNDER age 18, it is still considered a sexual offense by the elder child. The younger child is assumed to not be able to make consentual decisions due to age, therefore ANY activity is assumed to be NOT CONSENTUAL. Be aware that the an offender of any age may be required to register as a sexual offender once they become an adult, due to an offense committed as a juvenile. Do not quote me on this, but I do believe it is correct information. You need to do more research and search ND law. What I've read may be outdated, but it is not that old, so I don't believe it is outdated.

On the flipside...please carefully consider your actions. The way the law is written now, if a young person commits an offense, they are likely to have to register as a sexual offender for the rest of their life (or at least several years). Suicide is common amongst young children in this position. They don't see a future once the reality of their actions starts to set in. My belief is that the law probably needs to be addressed for younger people commiting crimes. Society is such that our young people see sex and sexual acts and lesbian/gay acts as perfectly acceptable. The problem is, they are getting into legal trouble. If we aren't going to change society expectations of our young people, then we might want to consider modifying the law to accomodate what is acceptable. Mind you...I believe we should modify society expectations, but it's pretty hard to change all that we have already trashed.
