Bond is set for the man accused of being behind the wheel in a fatal hit and run accident last November in Dickinson.
47-year-old Timothy J. Menges was arrested Monday, after more than one source went to police with information about what happened that caused the death of Tracy Freer.
Freer died after he was hit by a gray pickup near the motel that he and his wife owned-- the Queen City Motel--along Villard Avenue.
Menges was arrested and charged with negligent homicide, a class C felony.
Wednesday morning, his bond was set at 5-thousand dollars cash--with conditions of not being able to leave the state--or have a gun in his possession.
Tracy's loved ones made their objections known on their way out of the bond hearing.
They did not want to speak on-camera, but told me it's an insult to Tracy's life to set Menges' bond at $5,000.
They say Tracy's life is worth much more than that.
Appearing through I-TV, Menges did say he was sorry to the Freer family for not coming forward sooner. He says he felt guilty about that, but the fiancee of Tracy's brother says after waiting 3 1/2 months, she can't believe he had the audacity to say that to them.
Menges did say he has no money and will next apply for a court-appointed attorney before his preliminary hearing.
A class C felony carries a maximum penalty of five years in prison and a five-thousand dollar fine.
State's Attorney Rhonda Ehlis says Menges has some criminal history in North Dakota including charges for carrying a concealed weapon, Driving Under the Influence and Driving Under Suspension.
He's been a resident of Dickinson for around two years, but is originally from Missouri.
