Jury Convicts Colten Towry of Aggravated Assault

Jurors reach a verdict in a case involving the death of a Bismarck man but it's not what prosecutors had pushed for.

Colten Towry was charged with manslaughter for causing the death of Derek Oshkeshequoam last October in Mandan.

Jurors this afternoon, found Towry guilty of a lesser charge of aggravated assault.

Towry hit Oshkeshequoam in the face at a Mandan party.

Oshkeshequoam was knocked unconscious but wasn't taken to the hospital until two days later.

A forensic expert for the defense says Towry's one hit did not kill Oshkeshequoam.

Defense attorney, Kent Morrow says, "we have several impact points. Not just one, not just two, several that caused injury to his brain."

Morton County Prosecutor Brian Grosinger says, "What started the ball rolling? Mr. Towry's conducting choosing to put himself in a situation, striking, hitting Mr. Oshkeshequoam. As a result of him putting himself in this situation and everything else follows accordingly."

Towry will be sentenced at a later time.

Aggravated Assault is a class B felony, with a punishment of up to 10 years in prison.
