The owners of the Minot Daily News have won a court ruling allowing them to continue using their parking lot while a case progresses regarding the status of the land.
Northwest District Judge Paul Jacobsen ruled last week that Ogden Newspapers of North Dakota should have access to its land just north of the current Ward County jail.
The county had taken what's called a "quick claim" eminent domain action to seize immediate control of the land.
The county wants to expand its jail onto the land now owned by Ogden and had moved equipment onto the land after filing the "quick claim" action.
But the judge's ruling orders the land to be cleared of any county materials while the standard eminent domain procedure moves on.
That procedure could include a jury trial to decide whether or not the county can take Ogden's land.
The county has offered to pay just over three-hundred thousand dollars for the land in the eminent domain process.
