Fired City Attorney Makes Document Demands

The woman fired as Minot's city attorney on Friday has requested all documents related to her employment be preserved.

Colleen Auer had been on the job as city attorney for barely a month when she was let go.

As we heard from her yesterday on KX News, she maintains she was dismissed in retaliation for an employment complaint she had made against her supervisor, interim city manager Cindy Hemphill.

Auer filed a complaint alleging harassment, a hostile work environment, and being prevented from doing the duties she was hired to perform.

Because she was a new hire, Auer was considered a probationary employee, subject to dismissal without cause.

But she says that does not allow the city to fire her as punishment for filing an employment complaint.

And Auer says she has notified the city that all employees must preserve all information related to her employment.

(Colleen Auer, Former Minot City Attorney) "And when I mean information, I mean information that's in the possession of the city or any public official that's of a business nature that's on either a business computer, or anybody's personal laptop, cellphone, recording, you name it. So number one I've told them don't destroy your stuff because I'm coming after you for this."

Auer says she has also made a formal request to receive all documents related to her hiring, employment, and firing.

The former city attorney plans to file wrongful termination complaints with state and federal agencies, and pursue a lawsuit against the city over her firing.
