Was Attorney's Firing Legal?

The woman fired as Minot City Attorney late Friday says her dismissal was illegal under city codes and state laws.

Colleen Auer was fired just before 5-pm on Friday afternoon.

She was given a one-line letter from the interim city manager saying she was being terminated immediately.

Auer says the manager, the city human resources director, chief of police, and one other police officer were in her office when the firing happened.

She says the city manager told her it was the decision of the city council to dismiss her.

But Auer cites the city code saying the city manager must consult with the city council before removing a department head such as the city attorney.

And the city council has not held a meeting since April 7th, when Auer had been on the job for one week.

Auer says attorney general's opinions show that the words "the city council" mean a vote by a majority of council members present at a properly-publicized meeting with a quorum present.

Auer says she is requesting - this morning - proof from the city of a council meeting where a vote was taken to fire her.

She says she is also hoping to meet with the state attorney general today to make an open meeting complaint.
