Radio station owner Stokes fails again to gain Chapter 11 bankruptcy
By TRISTAN SCOTT of the Missoulian | October 9, 2009
A controversial talk radio host and station owner from Kalispell lost another bid for Chapter 11 bankruptcy on Thursday, two weeks after officials seized his assets and ousted him from the airwaves.
John Stokes, who owned the KGEZ radio station, represented himself as a pro se litigant during a motions hearing in U.S. Bankruptcy Court in Missoula. He asked for an additional 20 days to prepare for his arguments, saying legal paperwork critical to his case has remained locked inside the station since he lost control of his assets and was ushered off the premises on Sept. 24.
"It's impossible to have a fair proceeding," Stokes said. "All my court files remain in that building."
Bankruptcy Judge Ralph B. Kirscher, whose earlier legal rulings converted Stokes' Chapter 11 bankruptcy to Chapter 7 liquidation, refused to allow him any additional time and warned that he would deny the motions unless Stokes could convince him otherwise.
"The court has all my evidence," Stokes said. "So if you have to deny them, deny them."
Stokes' on-air legacy has been marked by controversy for years, with supporters extolling his anti-environmental views and critics condemning what they said were radical screeds. Stokes has made headlines by referring to environmentalists as Nazis and by burning green swastikas outside his station.
In recent years, however, Stokes has become best known for his role in various legal proceedings, including last year's $3.8 million defamation judgment against him; a jury ruled that Stokes knowingly made false on-air comments about neighboring business owners, Davar and Todd Gardner, and that he had done so with malicious intent.
The judgment sunk Stokes into debt, which, coupled with his previous financial difficulties with mortgage creditors and tax collectors, forced him to file for Chapter 11 bankruptcy. But questions quickly arose over his financial filings, which showed huge discrepancies in asset values, and trustees asked that his bankruptcy be converted to Chapter 7 liquidation, under which he would lose control of his assets.
Judge Kirscher eventually ruled that Stokes should be placed in Chapter 7 bankruptcy, writing in his decision that Stokes had failed to accurately disclose his assets to the court, had failed to meet financial reporting requirements, had failed to pay filing fees and had not filed state or federal income taxes for years.
"Literally millions of dollars of purported assets were omitted," Kirscher wrote, including lawsuits, all-terrain vehicles, snowmobiles and at least one boat. Stokes initially listed personal property assets of $148,000, for instance, but later amended that to more than $15 million.
"His declarations," the judge determined, "are not truthful."
Kirscher said Thursday that motions for reconsideration under Chapter 11 bankruptcy are "extremely limited" in their scope, and that Stokes had ample time to prepare for Thursday's hearing.
"I think given your intellect and knowledge of this case you've had adequate preparation to support your position in these matters," Kirscher said. "In any event, these motions for consideration are denied."
James H. Cossitt, a Kalispell attorney representing the Chapter 7 trustee in the matter, said the issues raised in Stokes' motions don't require any documentation and would "just be plowing old ground."
Stokes said he unsuccessfully sought representation from 45 different attorneys - including Cossitt - but has finally retained counsel from Atlanta who will be arriving in Montana next week.
Cossitt said the trustee will decide how best to liquidate the assets and repay those with a claim on Stokes.

The judge who sentenced the juvenile to register as a sex offender was clearly in the wrong. Ex post facto (retroactive) legislation is simply not legal and any 2nd year law student should know that.
The kid must be Native American or he wouldn't be tried in Federal Court for a sex offense. The chances are that he had no job skills and may be living on a rez with 40% unemployment, so there would be little chance that he would find work, especially with his record. If he had to register, it would make finding employment that much harder, because vigilantes prowl the sex offender lists to make registrants that much more difficult, or even to kill them.
That doesn't excuse the kid from not looking for work. He should have know to pretend. I'm reminded of the old Soviet factory worker joke: We pretend to work and the bosses pretend to pay us. Reply...
If Baucus has a bill that he thinks will make it out of committee, it would of necessity be a terrible bill. He has been assiduously looking out for the interests of pharmaceutical and insurance industry for the past decade and is unlikely to switch his allegiance to consumers at this late date. After all, their former point man in the House, John Breaux, had a two million dollar job waiting for him the day he retired. He, like Baucus, was a Democrat whom the industry could rely on, though he changed parties when the leadership changed.
The only two members (I am not including Max in this) who MIGHT vote for a good bill are Jeff Bingaman and Olympia Snowe, but she'd have Republican caucus pressure against voting her conscience. They don't want ANY of the problems of the health care sorted out if it affects their big money contributors. Reply...
Greg Smith may not have a listed phone #, and his Twin Rivers Authority cell phone was taken away a week ago, but he shouldn't be that hard for a real reporter to reach...his family owns the theater in town.
That's assuming that there is a real reporter who is interested.
The question remains why he was fired. If it was because he couldn't do his job, everyone on his board should have resigned because they haven't done their jobs either. If it was because he negotiated the contract that will keep their minimum-security jail empty for the next six months, they were the ones who approved it and who continue to defend it as viable, despite all the circumstantial evidence to the contrary.
They don't have to tell the public why they fired him. If it was for something nasty (i.e., sexual harassment, embezzlement, etc.) then he would be equally disinclined to say something about it.
It's certainly worth a call, though.
If a real reporter can be found.

That sounds like our grand-daughter. When you sleep with her you need to wear a football suit with lots of protection. She and my husband took a nap when she was really little and he decided if he ever napped with her again he was going to wear a groin protector cause she kicks like a mule. She is a cute mule though I miss the little tyke. Hard to believe she is almost nine now.
OUr son is in Washington DC today. so is wife. He nominated his company (Microsoft) that he works for in his civilian job for a national award for employers who go beyond the normal for NG troops. Well, long story short, they won second place and are having an award ceremony in DC for all the winners. So the guard sent him to be there and be part of the ceremony. His wife could come as well but they had to pay here way. So I will keep you posted and if I get a picture I will try to post it.
Today, I wanted to paint outside but it is too hot on the south side of our house if it is much above 70. At least too hot for me. I keep thinking it would cool down but not yet. Sounds like it will be warm again today. I have some furniture I want to strip might do that. ORRRR I could do some quilting. I am making our son a quilt for Christmas and it has his company logo and the logo for KFOR 12 on it. That is the name of the mission to Kosovo he is on. I got a good start the other day when I went to Riverdale to my friends house. She is good at that kind of thing and I needed help getting going.
I sure do hope your son is feeling better soon Shoppe. I will pray for him. I know that it usually responds well to meds once a person starts but still takes a while to get over it.
I was sad to hear about another person who took their life. My husband knew him a little bit. I am not sure how but he said he seemed like a nice guy. I sure wish people would reach out for help for their problems instead. It almost seems like a double tragedy. How the family misses them plus the guilt and stigma that so often goes with it even though it is not their fault. It is a tragedy is all I can say.
Well, later ladies! Reply...

Hello? Hello? Can you hear me? LOL! Is this finally working? Holy crap....I thought I would go into withdrawals. What a horrible feeling being able to read but respond....
I only jumped on to see if there were any changes and woolah!!! I haven't read any post yet today. I am afraid to jump off...I might not get back on!!!! LMAO!!!
How are you guys? I missed you all sooooo much!!!!!! Well as you know I have had pc probs for a few days or is it this site? Actually it is this site because I used my bosses laptop and logged in, got all the way through to the NO CURSOR part where I can't type!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! Darn it!!!!! That is all ok, if, all is well now.
So let's see, I have nothing to talk about....hahahahahahah!!!!! Figures, I am so shocked that I am typing, I am at a loss for words. Let's see, I'm thinking, thinking, oh I know...my house is QUIET at the moment. Rol took the kids out of school early and brought them to the track...100 miles away for Johnboy to practice motox before his race Sunday. He got there to find it closed!!!! A sign hanging on the gate stating no water. So Rol walked down and spoke with Big Randy (he is of average size, he has a son Lil Randy, Shelb's boooyyyyfriend!!!!,LOL) Seems that the pond went dry...no water to water the track, and Big Randy was in the hosp[ital for a couple of days due to asthma. The hose was screwed up also...so the track was dry. VERY DRY!! Rol and Big Randy talked...when BR realized that he had driven from Biddeford...he told him to stay, hadn't charge him the $20 admission and allowed johnboy use of the track after he got it somewhat wet. Rol was going to try to pay him a second time, we'll see if BR ends up charging him or not. The dude is super good that way...maybe too "good" because he isn't going to make money doing that. Then if he doesn't make money he loses money and eventually sells, closes or something!!!! I want to see the guy stay above....he doesn't have to get filthy rich...hahahahahaha, but no need to give it all away. Let Rol pay the $20 and we are happy with not getting turned away!!! Does that make sense? Does to us! I am sooooo excited that I am here. If I don't come back you'll know why and you can catch me on FB!!!!!
Love ya!!!!! care29 xoxoxoxoxoxoxoxoxoxoxoxooxoxoxoxoxoxoxooxox
It's the best day everrrrrrrrrrrrrrrrrrrrrr!!!!!!!!!!!!! For real this time....no pretends!!!! LMAO!!!! Reply...
