I was injured at work in March of 03. I was accepted by workfarce safety and they did pay me until ss accepted me. Well, that was great but then I was to be evaluated for my permanent partial injury. First of all, they pick the doctor, paid by them. (he is not evne a doctor he is a chiropractor) An evaluation was made the my injury was worth $1800.00. I can't work and will never be able to work again. I have pain 24/7 and take many different meds to just get by. I am very thankful I am getting a disablility from ss but the full payment from workforce safety is a joke. I don't expect to get rich but to live with what I live with everyday it would at least have felt like I got acknolgement of my injury. I don't blame the workers there at wfs. My claims person has to abide by the rules set forth by people much higher up than her. I also wish a person could be evaluated by a doctor outside of the system and that evaluation could be considered as well. When the doctor is on the payroll and his neck is on the line if the "outcome" of his findings are not in wfs favor, I am sure his "outcome" is tilted in favor of wfs. I am glad to be done with them (except they still pay my medical except for the times they deem the treatment unneccesary, which is most of the time) Well, that is my story and it isn't a happy one either. I to was injured at work in fargo back in 1993 and have tried to jump through all of WSI's hoops with the end result being the same as all others. WSI controls any injured workers lives and plays with them like a game. Iam currently recieveing some assistance from WSI which took 3 years of fighting with them. The only reason that they are helping me now is that they legally have to, not because they want to. I was denied of course the first time, then denied on the appeal of course, even after they brought in their own doctor from Fargo to Bismarck, and she agreed with my three other doctors that my chronic pain was a direct result of my work injury. Than I went to the next step which was to go to court where I was going to represent myself because like all other injured workers, I couldnt aford or find a lawyer that will take on WSI, so it was myself against an attorny general assisant from Fargo. Pro esse, or something like that, after 3 or 4 months WSI agreed with me to a certain degree and said if I signed a paper that they would help me. I would love to give Jim Shaw my whole file from WSI for a news story, but WSI would cut me off and I can barely get by now. They will only help me until they can create a new law so that they can cut me off. I to went through their retraining to attempt to return t the work force with many failed attemps. Did any injured workers that have been retrained ever get a job at WSI? I believe that a injured worker should be the directer at WSI, the board of diecters should have at least half the members should be injured workers. WSI is such a joke, the employers and that idiot from the chamber of commerce part of the reason WSI is failing injured workers. I no longer call WSI by that name, I call them the North Dakota Mafia because thats what they are!!!!!! If all injured workers and other people that know they are a joke WSI should be run out of the state. Jim Shaw is a hero to injured workers and their familys. When I was hurt at work it took my attorny to sue my employer and six months to even look at where I was injured!!! By that time everything had been changed, WSI and OSHA both should have been there but niether one cared and still dont.... Where is that petition???? I will help get the needed signitures from people to include even the Mayor of a town who was the safety directer for a big company.........PLEASE DONT STOP LOOKING INTO WSI!!! They want it out of the news so they can get back to busness as always..I guess that guy from WSI called Mr. Brown a liar but not Mr. Schnider, I wonder why? Doesnt everybody just ask themselves what is going on!!!!!!!! Reply...

don't really know what to say other than I was Injured in a MVA about 4 years ago just know what people tell me about the reck and my months stay in saint a's hospital I was on my way in from a job and was less than 20 miles from the shop and they say i tried to avoide hitting a car head on as the person in the other vehicle was drunk and was coming down my side of the road causeing me to hit them and roll my semi. leaving me with a traumatic brain injury punctured lung and broken rib. as far as it goes with wsi i have done everything they asked went to every doctor they wanted me to go seeand never did i go and get a second opienion on my injury's as i have went to many many of the doctors that they wanted me to go to a while back they changed my status to total permanent disabled and know they say i am only 10 percent disabled but i still suffer from bad bad headaches and fatique and i can't get released back to work as who wants someone who can't be reliede on as i don't get to pick the day that i get a headache and know what time get tieredbut they rate me at 10 percent so they will not have to pay me for a permanent impairment payment cause you have to be 16 percent and above kind of funny that my doctor visits are the ones that i go to every 6months and see my nerologestwhich is one of many and he is one they set me up with and is the only one that has got me on the meds that help my headaches and help me sleep at night not complaining just leting you know from another type of injury WHAT A MESS they need to know at WSI that as injured workers WE DID NOT ASK FOR ANY OF THIS TO HAPPEN because if we did we would be as messed up as they are Reply...

Just in case there are any questions on the part when they force you into applying for Social Security. When and if you get your social security which takes a act of god also. But should you manage to get Social Security benefits. WSI treat those benefits as an income and deducts from you monthly WSI checks. Reducing your disability pay even more. If it take's some time to get your Social Security and you have back retroactive pay coming, WSI also dips into that and gets %6 of what you get from that back pay. Wouldn't want a person living at poverty level to get comfortable. Also can't help but wonder what kind of severance package the guy on the news program received since he most likely got fired because he told how it really is there in the WSI world. Reply...

This review will include any denial on claims filed from 7/1/1995 to the present.
All workers requesting a review must fill out the application form (C170) that is downloadable at
www.WorkforceSafety.com and then by clicking on the “Application for Continuing
Jurisdiction” link in the lower right hand corner of the WSI homepage.
The form can also be
obtained from WSI via phone or email through Customer Service number, 1-800-777-5033.
Applications are being accepted through June 30, 2008.

I have been dealing with WSI since 1990, and have had many go arounds with them. Who is watching over them. Employer pay in for their insurance coverage and WSI act like it's their money. I understand there are people who take advanage of the system, but there are people like me that truly do have an injury (lower back). For a period of time I was on both side of the table (injuried worker and worked for a company that handled their WSI. At WSI meetings we were to how to stick it to the employee but not how to help them when they do have a real injuy.

I want to thank you for bring this to the for front so people can see what is happen and how people work hard and then find themself hurt, then told nothing is wrong with you and WSI steps away. How sad. Reply...

Ok lets just put all the BS away for WSI purposes I'm Not a republican, not a democrat either, not a liberal. I am an American! disabled doing my Job to keep this state and its economy going. Everybody always point fingers at every one else. WSI has been doing this for a long time if there ever was a claim where they were stuck paying money out. There friends on the hill made sure it was law that it would not happen again just read the century codes they have one for every lame thing in the world to get out of paying. The Schneider law firm is the only advocate in Fargo area that is for the injured worker. Sorry to say most of the claim benefits that WSI turn down the Schneider law firm can do very little about. I was disabled eight years ago and just recently they put me on the disabled list. I was treated like dirt as it has been commented on. I had physical therapists tell me that the only reason I cannot do it is because I didn't want to or didn't try hard enough. I sleep three hours a night if lucky. Take so many pills that cannot concentrate on anything yet they ignore this and send you to retraining. Then hold benefits back you need to survive for non-compliance because you didn't try to learn. Ok put a ice pick in your back take half dozen pain pills then try go pay attention. Just don't happen!
I thank Jim Shaw and Fox News God Bless you, for finally bringing this out in the open hope to see more of it. Like the injured worker said tonight 2/12/08 on the WSI report. A person should be ashamed to work at a place that does this to people that have no other means of support. It's hell on earth! I live it and its not a choice I made It was a accident and it left me permanently disabled with severe chronic pain. And several other side affects from medication I have to take to make it through a day. The injured workers out there know what I'm talking about. The person that wrote in about them playing games until you get so fed up you go back to work I testify to this, that's A trademark WSI policy. Yet workers of this organization can do all sorts of stuff and hey its not a problem. How many of us could get away with identity theft, How many injured workers out there got a severance package to tide you over until you benefits were in place. I just hope out of all this the people it affects most get a little help in trying to survive. That's what this WSI organization is suppose to do in the first place, take care of workers who got injured and cannot work. That not on there agenda as it stands. Reply...

Kudos for an awesome job! My situation is very much like Mr. Brown's, and I know what him, myself and alot of other injured workers go thru on a day to day basis. We no longer have control of our lives, the pain has taken over, and it doesn't help when WSI continually makes every effort on their part to attempt to find ways to deny claims, only to fail. And thank you for your post, Morton Mom, with the working conditions and the drama... I hear it in the tone of voice and attitude everytime my claims person calls from workman's comp. At least they are able to work, are able to do things with their family. Unhappy with their job? Maybe instead of the drama, they should look elsewhere for employment. I too have kept up on this unsettling story. It is a shame, WSI has gotten away with this for so long. I work in the health field and see a lot of claims. I too have heard it takes an act of god to get anything settled. I guess they are looking out for only a few. With the large surplus of funds, you would think they could pay these poor people what they have coming. I guess they have to save it for the ex employees severence packages. Good job KXMB for reporting on the bottom side of this subject. Hope it does some good and changes the tactics of WSI. We are watching the governor and legislature. I am a ND voter. Reply...

I myself was injured years ago & was appalled at the way I was treated. Benefits I was entitled to were not explained to me. Never got calls back from my case worker, answering questions I had. I was pushed under the rug, in the hopes that I would give up & just fade away. So I did as I'm sure a lot of injured workers did.....went on to find another job, hoping I wouldn't have problems with my back. Only because I was broke & fed up!! It seems as if WSI is NOT for the injured worker....otherwise there wouldn't be people so frustrated that they give up. It truly is disgusting how the injured worker is treated, as if they aren't worth squat. It has been 2 years since my spouse was injured, and only now is he receiving some benefits. I just don't understand this. As an injured worker, you are treated as if you aren't worthy of anything. All I can say is I'd like to see what would happen if anyone at WSI got injured & had to go thru what others have.....then let's see how they like being on the other end!! Reply...

This is just more Republican controlled cover-up of the dysfunction and corruption of the W.S.I. It began when Republican Judge Robert Wefald dismissed the charges against Blunt and his cohort, Romi Leingang. It just continues through the Republican Attorney General Wayne Stenehjem and Republican Governor John Hoeven. Don't look for any changes adopted by the Republican controlled N.D. Legislature when it convenes in 2009. The Republican controlled Legislature got us into this mess and don't expect them to admit they were wrong and make the necessary changes to rectify their voting habits. Everyone in the Republican political field will someday need to "eat crow" concerning the W.S.I. debacle. Who did you vote for?
