The company whose building burned down in May is suing the City of Minot, trying to get permission to rebuild.
Earth Recycling’s facility was ruined in the fire that spewed thick black smoke across the valley on the west edge of Minot.
Since then, the city has been refusing to issue needed permits for the company to rebuild saying it does not fit with zoning rules.
The lawsuit filed yesterday says Earth Recycling is grandfathered in and should not be required to adhere to the rules.
The company is seeking court action to allow it to begin rebuilding.
