Conspiracy to Commit Murder Case Sent Back to Juvenile Court

A juvenile charged in adult court of conspiracy to commit murder has had his case dismissed.

Court Documents show the State’s Attorney’s office, requested the case be moved back to juvenile court.

The judge dismissed the count in Burleigh County court today.

The 16-year-old juvenile was part of a group of three boys that attacked a man in July with a baseball bat near McLean Bottoms south of Bismarck.

The three were charged in juvenile court, before one of the boys in October was charged with a Class AA felony in adult court.

He was the only one of the three juveniles whose case was bumped up.

Court documents in the case say the boys conspired to kill the male victim, before the attack all three later fled the scene.

The case now goes back into the juvenile court system.
