In October, Earth Recycling was denied a preliminary injunction.
The injunction would have prevented the city from putting a stop on Earth Recycling efforts to rebuild.
The city says Earth Recycling does not meet new zoning requirements, but the company has always argued it should have be grandfathered in.
At tonight’s city council meeting the council voted to reschedule talk about a possible settlement, making Earth Recycling very upset.
“Now we finally get a proposal, we respond to it right away I show up here with my client trying to make sure we can get this resolved for the betterment of that site and for the citizens of this town to allow recycling to occur, to allow a clean up after a tragic fire and now you table it for a week,” said Lynn Boughey.
The city council voted to discuss the issue sometime next week.
