Judge Rules in Earth Recycling Suit vs. City

A Minot company that suffered a huge fire a year ago has lost a legal effort to stay in operation.
Earth Recycling was trying to fight a City of Minot order to stop taking in recyclable materials at the site just west of Minot.

The city told the company it did not have the proper permits to continue as a recycling center and that it must clean up the site.
The company maintained it needed to keep operating to raise funds for the cleanup.

Judge Doug Mattson dismissed Earth Recycling’s lawsuit against the city and canceled the trial that was scheduled for this week.

In his ruling, Mattson said the parties need to, quote, “treat this matter like lunch and acknowledge there is no free cleanup,” unquote.
He concluded the motion saying although he must dismiss the case he is, quote, “left wondering if this result really advances the public good?”
