Joshua Lebsock says he never saw the arresting officer until he was grabbed from behind.
“So I just turned to him, ‘What are you doing?’ I had no idea it was a police officer right away,” says Lebsock.
Lebsock was arrested outside of his place of business,-a gym featuring yoga, kickboxing, and MMA classes-where officers responded to a call of an alleged assault.
When Lebsock asks why he is being placed under arrest in the video, no audible answer is provided.
Lebsock, who has a ‘Back the Blue’ sign displayed outside his business, says he’s always been supportive of law enforcement. But wants better communication in similar situations.
“Hey, let’s get the training. Why not train so you can be calm in situations that will rise to a heightened state,” says Lebsock.
The officer who arrested Lebsock had been with the department less than three months. In a statement, the police department said in part “The officers who conducted the arrest of Lebscok did follow department policy and training guidelines that have been put in place for the safety of our community.” The statement can be read in its entirety below.
The department declined to comment further.
“It can never be us versus them. It can never be this Yagaelan dialect. It always has to be a conversation and a democracy,” says Lebsock.
Lebsock says though he feels he was unfairly treated, he still backs the blue. He also says he has plans to host a free community MMA workshop in the coming days.
Lebsock has been charged with aggravated assault, a C-class felony. If convicted, he could face up to five years in prison.

“On August 10th, 2017 at approximately 7p.m., the Williston Police Department responded to a call for service of an assault in the 500 block of East Broadway.

Law Enforcement made contact with a juvenile male. The male indicated that Joshua Lebsock had grabbed him around the neck with Lebsock’s right hand and slapped him with his left. The male indicated he had difficulty breathing while Lebsock had him by the neck. The male also indicated this had transpired during a verbal altercation with Lebsock inside the business.

Responding officers made contact with Lebsock who was yelling profanities at officers and community members. Lebsock was subsequently arrested and formally charged with C-felony aggravated assault.

The Williston Police Department fully protects the first amendment rights of our community. As well, the facts of the investigation will be played out in the court of law, allowing for many questions to be answered at that time.

The officers who conducted the arrest of Lebsock did follow department policy and training guidelines that have been put in place for the safety of our community.

The Williston Police Departments mission is to protect and serve the community with the upmost respect and dignity and will continue to do so.

We appreciate and value our relationship and support we have with our community.”
