“Why am I hearing this at the eleventh hour?”
Those were the words of District Judge Gary Lee today when prosecutors said they were dismissing a Gross Sexual Imposition charge against a Bowbells man.
The prosecutor said the rape case against Scott Flood fell apart on credibility issues with key witnesses including the victim.
Flood did enter a guilty plea to Aggravated Assault.
But the two sides differed on the sentence he deserved. The defense argued for no jail time beyond the 378 days he’s served since being arrested.
Judge Lee instead agreed with the prosecution and ordered Flood to serve three years in prison, followed by three years probation.
